Dear Judge Burke,

I represent Plaintiff, Robert Finkelstein (“Plaintiff”), in connection with the above-captioned matter. This case was assigned to Judge Lesa Gelb and was scheduled for trial in August, 2012. The parties agreed to resolve the matter by way of binding arbitration and Judge Gelb took same off her trial calendar.

The parties agreed to employ Neil T. O’Donnell, Esq. as arbitrator. The arbitration was conducted on October 22, 2012 at Attorney O’Donnell’s offices in Kingston. The case is resolved and the parties are finalized the closing documents. I wanted to commend Neil for the time and effort he devoted to the parties in serving as arbitrator. This matter involved many issues and voluminous documents. When asked for his bill for services rendered, Neil graciously advised he was not seeking renumeration. I thought that Your Honor and Judge Gelb should be made aware of Neil’s unselfish, laudable actions. Every practicing lawyer in this area, especially those just starting out, should look to Neil as an example of what we should all strive to be. He is an asset to the bar and our profession.

Thank you.

Respectfully yours, James A. Kilpatrick
