  • Criminal cases are filed by the state and seek punishment for the perpetrator.
  • Civil cases are filed by survivors themselves and seek financial damages from those responsible.


Importantly, the burden of proof in a civil case is lower than in a criminal one—meaning survivors may achieve justice even if criminal charges aren’t pursued or fail to result in conviction.

Pennsylvania’s Statute of Limitations for Sexual Abuse Cases

The timeframe to file a claim depends on the nature of the abuse:

  • Workplace sexual abuse: generally two years from the date of the incident.
  • Child sexual abuse: survivors can file until age 30 for civil claims and until age 50 for criminal prosecution.
