<p>With the internet and artificial intelligence making it easier to collect personal information and impersonate others, scams are becoming increasingly sophisticated. One alarming example involves fraudsters posing as sheriffs, U.S. marshals or other authorities and falsely claiming that the person they have called missed jury duty.</p>

<h3>How a Jury Duty Scam Works</h3>

<p>The storyline is generally simple. A scammer calls while impersonating a law enforcement officer or another government official. To sound convincing, the caller may recite basic personal information, such as your name and address.</p>

<p>Then comes the hook: The caller claims that you failed to report for jury duty and that a warrant has been issued for your arrest. The scammer may demand thousands of dollars in supposed bail or fines, often insisting that payment be made immediately through a payment app, cryptocurrency or another difficult-to-reverse method.</p>

<p>Although the story may seem suspicious in hindsight, these scams are designed to trigger panic. By creating fear and urgency, the caller attempts to push the victim into acting before there is time to question the suddenness or strangeness of the demand.</p>

<h3>Warning Signs of a Jury Duty Scam</h3>

<p>The Federal Trade Commission offers several important reminders for recognizing this type of fraud:</p>

<ul>
  <li>Police will not call or email you an arrest warrant.</li>
  <li>Law enforcement will not call to warn you of an impending arrest.</li>
  <li>A legitimate officer will not threaten to arrest you simply for ending a phone call.</li>
  <li>The government will not demand immediate payment by phone through cryptocurrency, a payment app, gift cards or similar methods.</li>
</ul>

<p>If you receive a call like this, do not let the caller's threats or sense of urgency control your response. Hang up, take a moment to think and independently contact the relevant court or law enforcement agency using a verified public phone number.</p>

<h3>What to Do If You Were Scammed</h3>

<p>If you sent money or shared financial information, contact the bank, credit card company, payment app or other company involved as soon as possible. Explain that the transaction was fraudulent and ask whether it can be reversed.</p>

<p>If you gave the scammer your Social Security number or other sensitive personal information, visit <a href="https://www.identitytheft.gov/" target="_blank" rel="noopener">IdentityTheft.gov</a> for a personalized recovery plan. You should also <a href="https://reportfraud.ftc.gov/" target="_blank" rel="noopener">report the scam to the FTC</a>. Reporting fraud helps authorities identify patterns and respond to evolving scams.</p>

<h3>How Flock Safety’s AI-Assisted License Plate Cameras Work</h3>

<p>Flock Safety purportedly helps law enforcement by installing AI-assisted cameras in certain areas. They photograph the license plates of vehicles and collect other identifying information for law enforcement use. The company claims that they scan approximately 20 billion license plates per month. That data can be shared by police departments across the country.<sup>1</sup></p>

<h3>Flock Safety AI Cameras Vandalized</h3>

<p>AI cameras owned by Flock Safety have recently been vandalized by saws or spray paint.<sup>2</sup></p>

<h3>Questions About Flock Cameras and Crime Reduction</h3>

<p>Flock’s website boasts that these cameras lead to faster cases, fewer officers, and tighter budgets. An advertisement on their website perplexingly points to lowering crime statistics. This is despite crime, both violent and property, having been steadily decreasing since the 1990s.<sup>3</sup> As such, it’s difficult to discern the level of utility these cameras provide to fighting crime. What we do know for certain is that these cameras are emboldening various heartbroken or clingy individuals in law enforcement.</p>

<h3>Unauthorized Police Use of Flock’s Camera Network</h3>

<p>Reports indicated that at least 50 law-enforcement personnel have used Flock for unauthorized purposes, mostly related to stalking their significant others and ex-girlfriends.<sup>4</sup> In one instance, a policeman searched his ex’s license plate hundreds of times. Flock gave departments broad discretion regarding safeguards that would deter misconduct. Those safeguards were underutilized, which resulted in those personnel having a very expensive search service at their fingertip.</p>

<h3>Flock Safety’s New Data Privacy Safeguards</h3>

<p>For what it’s worth, Flock says that they are working to enhance safeguards. These include tools to adopt flags for abnormal usage activity for review, as well as reducing the default data-retention period from 30 to 7 days. One wonders how the latter will be much help, since the department can change data retention from the default rate. Regardless, this is just another example of AI accelerating onwards, and some people being subject to privacy violations.</p>

					<h3>Rising Insurance Claim Denials</h3>

<p>Plaintiff’s attorneys across the country have noticed an uptick in denials of uninsured/underinsured motor coverage (UM/UIM) by insurance companies. The concrete data is now coming in.</p>

<p>A recent Wall Street Journal article finds that, over a span of 10 years, there have been a striking increase in denials of auto-insurance liability, medical, and UM/UIM claims.<sup>1</sup> Employees of the Journal analyzed date filed to the National Association of Insurance Commissioners for the period between 2016 and 2025. Liberty Mutual had the highest increase of denials, surging from 29% in 2016 to 54% for 2025. They are closely followed by State Farm, who went from 26% to 47%. Geico was relatively steady, going from 35% to 37%; their insureds know of the company’s consistency right from the Gecko.</p>				</div>

<h3>What May Be Driving the Increase</h3>

<p>The cause of this phenomenon is assumably multifaceted, but we can gleen some information from the numbers. Team Shoreline, a public adjuster company servicing Florida, Minnesota, and Wisconsin, notes that the share of low-dollar claims dropped from 41.5% in 2019 to 25.5% by mid-2025.<sup>2</sup> This means that drivers are filing a larger share of expensive claims, which insurers fight harder against.</p>

<h3>Bad Faith Insurance Practices</h3>

<p>Some of this may be bad faith insurance practices.<sup>3</sup> Bad faith requires proving that (1) the insurer did not have a reasonable basis for denying benefits under their respective policy, and (2) the insurer knew or recklessly disregarded its lack of a reasonable basis in denying the claim.<sup>4</sup> Some examples of bad faith border on ludicrous company behavior.</p>

<h3>What This Means for Insurance Claimants</h3>

<p>Taken together, insurance claimants are increasingly feeling that the deck is being stacked against them. Claimants’ attorneys feel that bad faith insurance practices can’t be properly pursued under governing law. It can at times be a vexing situation, but not unworkable.</p>

<p>More than 6 months after a kidnaping that stirred the nation, little progress seems to have been made.</p>

<h2>The Disappearance of Nancy Guthrie</h2>

<p>Nancy Guthrie, an 84-year old retired university administrator and mother of the former Today Show co-host Savannah Guthrie, was reported missing at 12:03 p.m. on Sunday, February 1, 2026.<sup><a href="#source-1">1</a></sup> A family friend had called Nancy’s middle child, Annie, that Nancy had been absent for a routine church service that morning. Annie went to the home and found the back door open along with personal items that Nancy always keeps close. At 2 p.m., the sherrif’s department lead supervisor on the scene reported this as a missing person case. Minutes later, he called the homicide department.</p>

<h2>Questions Surrounding the Investigation</h2>

<p>Evidently, the homicide department of Pine County, Sgt. David Stivers, has been the center of local controversy. He was previously blamed for delays in securing crime-scene evidence, and accused of poor judgment. Homicide arrived at the scene, but neglected the blood on the porch for hours. The blood was suspected to have originated from an unrelated incidental injury. After analysis, the department began to believe it was related to the kidnapping. The department’s $1.7 million surveillance aircraft remained unused for several hours; only one pilot was trained for its use, and he or she was recently demoted following a workplace complaint. The plane began flying at around 6:30 p.m., but by then it was too dark to be of effective use.</p>

<h2>Ransom Notes Issued</h2>

<p>Two ransom notes, allegedly from the kidnappers, were issued. The first demanded an exchange of $4 million in Bitcoin by February 5 at 5 p.m. for Nancy’s release. That price was never paid. Unfortunately, the second ransom note, released the following Friday, hinted that Nancy was already dead. The FBI, who quickly partnered on the case, has determined those notes to be fakes.<sup><a href="#source-2">2</a></sup></p>

<h2>No Suspects Publicly Disclosed</h2>

<p>There are apparently no lead suspects, at least, none publicly disclosed.</p>

<h2>Uber Seeks Disclosure of Outside Litigation Funding</h2>

<p>Uber is seeking to have disclosure requirements for lawsuits funded by outside investors.<sup>2</sup> Under Uber’s plan, customers or drivers who sue the company will have to disclose those funding arrangements. This is an effort to counteract a rapidly evolving litigation funding industry, where parties agree to fund litigation efforts against companies such as Uber in consideration for a share in settlement or judgment winnings. Uber, joined by several other companies, is lobbying Congress and several State legislatures for statutory changes to curb these practices, but those efforts have stalled.</p>

<h2>Uber’s Efforts to Limit Liability</h2>

<p>This is evidently an attempt by Uber to limit liabilities resulting from numerous lawsuits arising from Uber drivers assaulting and/or harming customers. An $8.5 million verdict is easily payable by Uber, but the company has a vested interest in stemming the tide of potential litigants. Whether or not these measures will be effective remains to be seen.</p>

<h2>A Better Focus: Effective Background Checks</h2>

<p>In our view, Uber’s efforts are better directed toward effective background checks.</p>

<p>One may sue the Commonwealth of Pennsylvania, but only in limited circumstances. If the State does not consent to being sued, then it, and its officials and employees acting within the scope of their duties, enjoy sovereign immunity. The State Constitution mandates that the legislature may choose which claims are appropriate. These exceptions are strictly construed by the courts. One of these exceptions is the real estate exception, for damages caused by a “dangerous condition of Commonwealth agency real estate[.]”<sup>1</sup> The real estate exception is the focus of a case with particular set of facts.</p>

<p>Geoffrey J. Schmidt tragically sustained fatal injuries when the branch of a large tree fell and crushed his vehicle on a Commonwealth highway in Montgomery County.<sup>2</sup> His estate sued PennDOT and other Defendants, bringing claims in negligence, wrongful death, and the Survival Act. The estate tried to use the real estate exception to bring the case to PennDOT, arguing that the Department failed to provide sufficient warnings concerning the hazardous environment. Under this logic PennDOT, a Commonwealth Department, would be immune from suit unless the real estate exception to sovereign immunity is applicable. The issue is that the tree, albeit overhanging over a Commonwealth highway, was based on property owned by the Southeastern Pennsylvania Transportation Authority (SEPTA). SEPTA is separate from the Commonwealth, so SEPTA’s liability status does not have bearing on the effectiveness of any claim against PennDOT.</p>

<p>This left Plaintiff arguing that PennDOT should be held liable because the tree is located above PennDOT’s right-of-way. The trial court appeared to believe that Plaintiff had a case, for they denied PennDOT’s motion for summary judgment on the issue. The Commonwealth Court was not as persuaded. Conceding that PennDOT could have trimmed the tree, the “right to perform maintenance does not confer property interests sufficient to expand the scope of the real estate exception” to instances where the tree originated outside of the Department’s right-of-way.<sup>3</sup></p>

<p>Schmidt’s estate successfully appealed to the Pennsylvania Supreme Court, echoing the same argument used in the lower court. Oral argument was held in May, but the justices appeared split on the issue.<sup>4</sup> The justices had taken the arguments under advisement. Schmidt’s estate would need to survive on the Supreme Court level to keep PennDOT in the case. Should the estate prevail, they would still need to prove PennDOT’s liability before a jury.</p>

  <h2>Sports Betting’s Growing Role in Everyday Life</h2>

  <p>Gambling, especially sports betting, has intrusively become a facet of many everyday lives in the United States. Young adults are the most affected cohort. Research shows that 31% of young adults ages 18 through 29 have bet money in the last 12 months with friends or family.<sup>1</sup> And 17% of adults over 30 years of age have wagered online in the past year, up from 7% three years ago.</p>

    <p style="margin:0;"><strong>Key Context:</strong> Research shows that 31% of young adults ages 18 through 29 have bet money in the last 12 months with friends or family.</p>

  <h2>Public Concern Over Legal Sports Betting</h2>

  <p>Americans are increasingly believing that this is a bad phenomenon. Of those surveyed, 43% said that the prevalence of legal sports betting is bad for society, and 50% said it was neither good nor bad. This left 7% in favor. As time goes on, society has become tuned to the negatives of prevalent and convenient gambling.</p>

  <h2>Brendan Sorsby’s Case Against the N.C.A.A.</h2>

  <p>Texas Tech quarterback Brendan Sorsby feels these negatives acutely. Sorsby began gambling in high school, where he partook in both physical and online parlors.<sup>2</sup> He took this habit to college, where he would bet for his own team while as a freshman at Indiana University. Revealing this information must have been difficult for Sorsby, but it also puts him in trouble with governing authorities. The N.C.A.A. rules state that betting on one’s own team is punishable by permanent ineligibility. The N.C.A.A. denied Sorsby’s reinstatement request on May 26, 2026.</p>

  <h2>What an Injunction Could Mean</h2>

  <p>Sorsby decided to sue the N.C.A.A. in Texas state court, seeking an injunction against the organization. When a court issues an injunction, it prevents the enjoined party (here, the N.C.A.A.) from conducting certain actions. The court has the power to prohibit the N.C.A.A. from placing Sorsby on permanent ineligibility status on account of his gambling at Indiana.</p>

<h2>Supreme Court Decision</h2>

<p>A 5-4 U.S. Supreme Court majority recently found that a Mississippi trial court inappropriately prevented the Defendant from arguing that prosecutors struck potential black jurors on account of their race.<sup>1</sup></p>

<h2>Background of the Case</h2>

<p>In 2004 Terry Pitchford, 18, robbed a grocery store with Eric Bullins, 16. Over the course of the robbery, Bullins shot and killed the store owner, Reuben Britt, a white man.<sup>2</sup> It’s disputed whether Pitchford shot Britt.<sup>3</sup> Bullins ultimately entered a plea deal for a 20-year sentence. Pitchford elected to have a trial, wherein he was charged for capital murder. The jury panel included 40 black individuals and 84 white individuals. Parties conducted voir dire, allowing them to strike potential jurors from the pool for cause shown, which narrowed the pool to 5 black individuals and 36 white individuals.<sup>4</sup> The lower court stated that 30 of the black individuals were struck for their views on the death penalty.</p>

<h2>Peremptory Strikes and Jury Selection</h2>

<p>The next stage of procedure is what gave rise to the U.S. Supreme Court case. Following voir dire, the parties are given an opportunity to exercise peremptory strikes on 31 of the potential jurors. Peremptory strikes allow attorneys to remove potential jurors without any given reason. Pitchford’s attorney struck 12 white individuals, while the State exercised seven: 3 white and 4 black. The jury pool of fourteen (12 jurors and 2 alternatives) consisted of thirteen white individuals and 1 black individual.</p>

<h2>The Batson Challenge</h2>

<p>The law states that prosecutors cannot exercise peremptory challenges based on race.<sup>5</sup> The defense must raise a Batson challenge to a prosecutor’s supposed race-based criteria. Batson is conducted in 3 stages: (1) the defendant must a sufficiently detailed objection that certain peremptory challenges raise an inference of exclusion based on race; (2) the prosecution must offer a race-neutral reason that for each of the struck potential jurors (here, the 4 black potential jurors)<sup>6</sup>; and (3) the defense is offered a chance to rebut the prosecution’s reasons as “pretextual”.<sup>7</sup> Trial courts are given leeway in how to oversee Batson challenges, but Pitchford claims that he was not given a sufficient opportunity to reach Batson stage 3.<sup>8</sup></p>

<h2>Conviction and Appeal</h2>

<p>After this procedure, Pitchford was convicted and sentenced with the death penalty. In 2010, the Mississippi Supreme Court upheld the conviction, finding that Pitchford waived his Batson stage 3 challenge because he did not advance a pretextual argument.</p>

<h2>Federal Review and Supreme Court Ruling</h2>

<p>The case was re-opened via habeas corpus petition circa-2023. This allowed for the federal court system to get involved. The Northern District Court for Mississippi found that Pitchford properly raised a Batson challenge, but the trial court brusquely pushed the matter aside to move the case along.<sup>9</sup> The Fifth Circuit overturned the District Court, finding that Pitchford waived the issue. The Supreme Court opinion, authored by Justice Kavanaugh, determined that “things broke down, and the ordinary trial-court procedure for resolving Batson claims at step three never occurred[.]” The Fifth Circuit decision was overturned and the case was remanded.</p>

<h2>Prior Related Opinion</h2>

<p>Evidently, this is the second time an opinion authored by Justice Kavanaugh overturned a murder conviction prosecuted by the relevant district attorney, Doug Evans.<sup>10</sup> The other opinion was written in 2019, where Curtis Flowers was accused of killing four people in 1996.</p>

<h2>What This Case Represents</h2>

<p>Ultimately, this case represents a slim majority of judges, while favoring lower court discretion for Batson challenges, want to see more of a concrete procedure at the trial court level. Here, the Mississippi trial court’s procedure was too loose for the Supreme Court’s liking. Moving forward, trial courts ought to have more concrete Batson procedures to prevent their final juries from being overturned.</p>

  <h2>Direct Primary-Care Practices</h2>

  <p>David Contorno recently told his story to the Wall Street Journal.<sup>1</sup> Foregoing insurance, he pays a monthly membership fee for direct primary-care practices. Among these are: constant access to a primary-care doctor, discounts on prescriptions, and access to coupons. By paying for this service, Contorno gets unlimited visits and off-hours support.</p>

  <h2>Cash-Pay Healthcare Options</h2>

  <p>Others opt for a simple cash-pay strategy. Such individuals search for health providers that list cash prices in their area. Not many cash prices are available, but a quick phone call can provide a quote on specific prices for services. Certain websites serve as bona-fide digital malls for cash-price vendors, such as UberDoc, RadiologyAssist, and Green Imaging.</p>

  <p>Still, interested individuals should be cautioned that the listed prices may not reflect the actual figures. Healthcare providers are only required to offer a “good faith estimate.”</p>

  <h2>Help With Hospital Bills</h2>

  <p>Things get trickier for services you have to pay for after-the-fact, like the ER. A nonprofit like Dollar For can help. Dollar For offers services to help individuals get through the payment process, and often helps lower the bill to boot.<sup>2</sup></p>

  <p>Non-profit hospitals should have avenues for financial assistance, the problem lay only in the time and paperwork to get there.</p>

  <h2>Healthcare Alternatives Can Be Lifelines</h2>

  <p>These are just a few examples, but such offerings are lifelines to people in need.</p>

<h2>Waymo's Driverless Vehicle Problem in Atlanta</h2>

<p>A small Atlanta neighborhood has begun to experience an early-morning nuisance: Scores of driverless vehicles, courtesy of Waymo - Google’s fleet of self-driving cars.</p>

<p>The traffic is problematic. It occurs between 6:00-7:00 a.m., and interferes with bussing for school children. Attempts by local residence to establish warning signs to stop this bizzare behavior resulted in the vehicles becoming stuck in a traffic jam, unable to turn around. Waymo announced that they are working to fix the vehicle routing. Normally, these vehicles are parked in company depots for their downtime. If not, they try to find on-street parking locations, for Waymos are only available in cities at the moment.</p>

<h2>Could Autonomous Vehicle Behavior Create a Public Nuisance?</h2>

<p>The strange behavior of these vehicles are obvious growing pains for the self-driving industry, but can potentially constitute as a nuisance. Almost two years ago, for example, Waymo cars woke San Francisco residents with incessant honking in the early morning. Nuisance of a public nature must involved a significant interference with general convenience or safety. Prolonged honking throughout many nights would be one such example. Clogging small town roads for prolonged stretches may also constitute such interference.</p>

<h2>The Future of Self-Driving Car Litigation</h2>

<p>As self-driving cars begin to spread throughout America, so too do such problems escalate. Given the amount of companies working on this technology, there may be a lot of avenues for litigation in the near future. Hopefully, for the public’s sake, the issues are settled in reasonable time.</p>
