By Neil T. O’Donnell and Connor Graham

Congress has begun its semi-annual discussion of increasing the weight limits of tractor-trailers.

The trucking industry has a lot of weight to throw around in lobbying. Driving/sales work is far and away the number one occupation for young U.S. men without a college degree. Big business utilizes its position as one of the largest industries to push for reforms that benefit profitability.

The Proposed Increase

A weight increase, the industry purports, would boost productivity and allow for fewer trucks on the road.

But the recent proposed increase — from 80,000 pounds to 91,000 pounds — comes with even heavier costs. Trucking accounts for a comparatively higher percentage of mileage-related costs, including pavement damage, congestion, and noise, primarily due to the vehicle weight and the associated precautions to support that weight.

One would think a roughly 12% increase in weight capacity would be further detrimental to public highways.

Would Heavier Trucks Really Mean Fewer Trucks?

It’s also dubious that a weight increase would lead to fewer trucks on the road.

Much like why increasing the number of lanes does not eliminate traffic, an increase in storage capacity may cause businesses to take more product throughout the year for transport. A change in capacity would prompt a change in behavior to match.

The change may prompt trucking companies to take on more goods for travel.

The Employment Impact

Lastly, it is doubtful that trucking unions would accept such a shake-up in employment. Should the weight increases lead to fewer trucks, then it stands to reason that fewer workers would be needed to man the trucks.

If that were to happen, the government would have to contend with the noticeable loss of employment opportunities for high-school educated men.

Pennsylvania Roads Are Burdened Enough

A survey conducted by the Coalition of Bigger Trucks found that 77% of respondents in Pennsylvania’s 8th Congressional District opposed a weight-limit increase for tractor-trailers.

Further, 88% were concerned with deteriorating highway conditions associated with heavier vehicles.

Pennsylvania’s roads are burdened enough, and the people understand this.

Let’s not make our highway situation worse.

On a spring night in 1991, a college prank turned tragic in Scranton’s Nay Aug Park. Two students from the University of Scranton were chased by Community Medical Center (CMC) security guards into the woods. In the darkness and confusion, they fell from a 75-foot cliff. One of them—Peter Graybar—lost his life. The other—Jerome Majeski Jr.—survived but sustained serious injuries that changed his life forever.

What followed wasn’t just a tragedy—it was a fight for answers.

A Complex Case with Life-Altering Consequences

The students had been attempting to remove a street sign as part of a prank when they encountered security guards from Community Medical Center. Instead of diffusing the situation, the guards pursued them into Nay Aug Park. The chase ended in a catastrophic fall from a cliffside path.

Hospital officials and security staff initially denied the existence of a chase. Reports were missing. Testimonies conflicted. Questions were raised about whether the guards had the authority to pursue the students into the park at all.

Attorney Neil O’Donnell, part of the legal team representing Jerome Majeski, helped shine a light on the truth. He questioned the lack of documentation, the guards’ coordination with the hospital’s PR department before speaking to police, and the absence of any sign that the students had tampered with vehicles or committed any serious crime.

“They were herding these kids like animals,” O’Donnell told the jury.

“Who runs 200 yards into a dark park without being chased? No one.”

Justice Delivered

In March 1997, nearly six years after the incident, a Lackawanna County jury found Community Medical Center and its guards 65% responsible for the death of Peter Graybar and the injuries to Jerome Majeski.

The verdict reflected not only the actions of the guards but the institutional failure to take responsibility in the wake of the tragedy.

A Firm That Fights for Families

At O’Donnell Law Offices, we understand that wrongful death cases are not just about compensation—they’re about accountability, truth, and justice. Families deserve answers. Survivors deserve support. And institutions must be held responsible when their failures lead to tragedy.

This case—rooted in our community, our streets, and our courts—remains a powerful example of why we do what we do.

If your family has suffered a tragic loss and you’re searching for answers, we’re here to help.

#WrongfulDeath #ScrantonLawyers #ODonnellLaw #JusticeServed #TrialAttorneys #AccountabilityMatters

Spotlight on Michael O’Donnell: A Legacy of Dedication and Community Connection

At O’Donnell Law Offices, Michael O’Donnell has built a career rooted in mentorship, personal commitment, and a deep connection to the Northeastern Pennsylvania (NEPA) community. With over 15 years of experience, Michael has dedicated himself to fighting for injured workers and negligence victims, bringing both skill and compassion to every case he handles. His journey to becoming a respected attorney is one shaped by family, community, and an unwavering sense of responsibility to those he serves.

A Career Inspired by Mentorship

Michael’s passion for law was sparked early, thanks to the guidance of his uncle and founder of O’Donnell Law Offices, Neil O’Donnell. From summer jobs filing paperwork to assisting in depositions, Michael had a front-row seat to the legal process long before stepping into law school. A defining moment came when he accompanied his uncle to Tennessee for depositions, witnessing firsthand the intensity and importance of legal advocacy. These experiences solidified his decision to pursue a career in law and, ultimately, to join O’Donnell Law Offices—a choice that felt like the most natural step in his professional journey.

“Ultimately, it was the easiest decision of my life to join my family at O’Donnell Law Offices instead of pursuing any other career opportunity in a bigger city or different area of the country,” Michael reflects.

Values Shaped by NEPA Roots

Growing up in NEPA, Michael was deeply influenced by his involvement in organized sports. The lessons learned on the field—teamwork, preparation, resilience, and respect—became the foundation of his approach to law. He recognizes that the legal profession is inherently competitive, and his background in sports instilled in him the ability to navigate both victories and challenges with grace.

Beyond his personal experiences, Michael sees his work as an ongoing investment in the community that shaped him.

“I don’t like to call it ‘giving back,’ but instead, being an ongoing participant in a community that has provided the tools and framework that helped to offer the opportunities and blessings we’ve enjoyed.”

The Rewarding Work of Serving His Community

For Michael, the most fulfilling aspect of his career is the personal connection he builds with his clients. The people he represents aren’t just names on a case file—they are former teachers, high school classmates, local business owners, and neighbors. This deep-rooted connection fuels his dedication to providing the highest level of legal representation.

“When someone from those areas of life chooses to trust one of us with their legal representation, I cannot think of a higher compliment,” Michael says. “Representing people from our home region makes it easy to put in the extra time and to get out of bed each morning knowing we’re working for both the immediate and greater good.” Michael says. “Representing people from our home region makes it easy to put in the extra time and to get out of bed each morning knowing we’re working for both the immediate and greater good.”

A Commitment to Community Involvement

Outside the office, Michael’s life revolves around his family and the NEPA community. With two young children, he and his wife, Jill, are actively involved in their activities, from youth baseball to gymnastics. As a coach, he relishes the opportunity to guide and support not only his own children but also their teammates and families.

“We’re just getting started, and I’m sure our adventures will take us to other activities and opportunities. When they do, we’ll be there for our kids, their teammates, and their families.”

Excellence in Legal Advocacy

Michael’s commitment to his clients has not gone unnoticed. As a certified specialist in workers’ compensation law, he has fought tirelessly for injured workers, ensuring they receive the justice and support they deserve. His clients consistently praise his professionalism, dedication, and personal approach:

I would highly recommend his firm without a doubt.

Anonymous

Looking Ahead

As Michael continues his work at O’Donnell Law Offices, his dedication to justice and community remains at the heart of everything he does. Whether advocating in the courtroom or coaching on the baseball field, he remains committed to the values instilled in him by his mentors, his upbringing, and his deep ties to NEPA.

For those seeking legal representation with a personal touch, Michael O’Donnell exemplifies what it means to be not just a lawyer, but a trusted advocate and community member.

The post Spotlight on Attorney Michael O’Donnell first appeared on O'Donnell Law.

Understanding Social Host Liability in Pennsylvania: A Legal and Moral Obligation

The tragic death of a North Pocono High School student in a car crash has left a deep mark on the community and highlights the serious dangers of underage drinking. Reports indicate that alcohol consumption played a role in the events leading up to the accident, serving as a sobering reminder of the importance of Pennsylvania’s social host liability laws.

What Is Social Host Liability?

Social host liability in Pennsylvania may hold adults legally responsible for providing alcohol to minors. Under Pennsylvania law, any adult who furnishes alcohol to someone under the age of 21 can be held accountable for any resulting injuries, damages, or fatalities. This principle underscores the severe consequences of such actions and aims to protect young lives and the well-being of the community.

The Role of Parents and the Legal Risks of Underage Drinking

Parents may sometimes feel that permitting minors to drink under their supervision is safer. However, Pennsylvania law is clear: furnishing alcohol to minors is illegal and comes with serious penalties, including fines, potential imprisonment, and civil liability for any harm caused.

Even beyond the legal consequences, the risks are immense. Providing alcohol to minors increases the likelihood of impaired judgment, reckless behavior, and life-altering outcomes, as tragically demonstrated by the loss of young lives. It is critical for parents and all adults to understand that these decisions carry significant moral and legal responsibilities.

At O’Donnell Law Offices, we understand the devastating impact that underage drinking can have on families and communities. Our experienced legal team is committed to supporting those affected by these tragedies. Whether you are seeking guidance, need legal representation, or simply want to understand your rights, we are here to help.

We approach each case with care, compassion, and a dedication to achieving justice for the individuals and families we represent.

Contact O’Donnell Law Offices

If you or someone you love has been affected by underage drinking or a related tragedy, we encourage you to reach out to us. Let us help you navigate these challenges and work toward a resolution that brings accountability and peace of mind.

To learn more about the wrongful death lawsuit related to this tragic case, you can read the full article from The Times-Tribune here.

As O’Donnell Law Offices celebrates 35 years of serving Northeastern Pennsylvania, we’re looking back at some unforgettable moments that shaped our journey. One of the more entertaining ones? A 1995 Times Leader feature about Neil O’Donnell—not for his legal work, but for a fun twist of fate involving his name!

At the time, Neil was already a well-respected attorney in Pittston, building a reputation for dedication and hard work. But in Pittsburgh, where he wasn’t as well-known in legal circles, his name carried unexpected weight—thanks to another Neil O’Donnell, the Pittsburgh Steelers quarterback!

During the 1994–95 football season, Steelers QB Neil O’Donnell led his team to the AFC Championship Game, creating a buzz throughout Pennsylvania. That’s when the O’Donnell family started noticing something funny: their name was opening doors—literally! From special treatment at restaurants to effortless tee times at golf courses, people assumed they were interacting with the famous quarterback.

One particularly memorable moment happened during a dinner out in Pittsburgh. When Neil handed over his credit card, it sparked excitement in the restaurant. “By the time they processed it, it must have been discussed through the whole kitchen,” Cathy O’Donnell recalled in the article. A waiter even approached and said, “I didn’t know you had blond hair,” realizing this Neil O’Donnell wasn’t quite the one he expected.

The couple’s young son, Neil, also got in on the fun—becoming a huge Steelers fan and proudly sporting gear with his name on it. Even though his ultimate favorite team was Penn State (despite having two University of Pittsburgh grads as parents), he loved cheering for the Steelers and their star quarterback.

While the Steelers didn’t clinch the championship that year, Neil O’Donnell (the lawyer!) continued his winning streak—helping clients, growing O’Donnell Law Offices, and becoming a trusted name in the legal community.

Thirty-five years later, we look back on these moments with a smile. Whether in the courtroom or the football field, dedication and hard work always lead to success. Here’s to many more years of serving our community—no VIP tee times required!

The post Flashback Article: When Neil O’Donnell Made Headlines—Off the Field! first appeared on O'Donnell Law.
