Contacting a Lawyer
Should Be Your First Move

With so much at stake after an injury, it’s always worth speaking with a lawyer immediately, as this can improve your odds of winning. However, acting quickly is especially important in Pennsylvania, thanks to two facts about our legal system.

A Short Statute of Limitations

In Pennsylvania, you usually have two years to file a lawsuit after an injury. While that may seem like a lot of time, building a strong case can take months or years. What’s more, the longer you wait, the harder it will be to collect important evidence. It’s wise to contact an attorney as soon as possible to avoid these difficulties.

Strict Comparative Negligence Rules

Pennsylvania judges must consider who’s at fault, then divide the winnings from there. For example, if the other side can prove the accident was 30% your fault, you’ll only receive 70% of the total settlement. If they can prove you’re more than 50% responsible, you’ll end up with nothing. For this reason, defendants will often try to lay the blame on you. Working with a qualified personal injury lawyer reduces this risk.

Do You Have a Case?

In general, before you can file a personal injury lawsuit, your situation must meet four requirements.

First, the defendant (the person who caused the injury) must have had a duty to the claimant (the injured party). For instance, your doctor has a duty to provide you with a reasonable standard of care.

Breach of Duty

Then, if the defendant fails to carry out their responsibility, they’ve breached their duty. In our doctor example, that could mean an incorrect diagnosis or a botched surgery.

From there, there has to be a
clear link between the breach
and the damages. In other words, there must be proof that the defendant’s actions caused
the harm.

Finally, you must have suffered or lost something because of the breach. These damages can include physical injuries, financial losses, emotional distress, and more.

If all four of these conditions apply to you, you may have a case.
An attorney can help you determine if your incident meets these requirements.
