  <p>On February 18, 2026, the Pennsylvania Supreme Court affirmed the Superior Court’s ruling reversing a Trial Court’s entry of summary judgment dismissing an injured man’s negligence lawsuit against his co-worker.</p>

  <p><em>Brown v. Gaydos</em>, begins as a result of September 1, 2016 incident where John Brown suffered injuries while working for American Concrete Solutions, Inc (ACS). Brown suffered crush injuries when the arm on a piece of industrial equipment, a skid loader, malfunctioned. There was no dispute that Brown was working for ACS at the time of injury and the workers’ compensation insurer for ACS paid benefits.</p>

  <p>The skid loader was owned by George Gaydos, a part owner and a fellow employee at ACS. Factually significant, Gaydos owned, maintained, stored, and insured the skid loader individually and separate from his employment relationship with ACS. Gaydos occasionally loaned the skid loader to ACS for use in connection with ACS’s operations.</p>

  <p>Section 72 of the Pennsylvania Workers’ Compensation Act (77 P.S. § 72) provides immunity from civil liability to a co-employee whose negligence caused injuries to a co-worker, so long as the injuries occur while the co-employee was in the same employ as the injured worker and acting within the course and scope of employment at the time of the incident.</p>

  <p>Brown filed a negligence lawsuit against Gaydos in his individual capacity arguing that because Gaydos maintained the skid loader outside of his work with ACS, inspected, maintained, stored, and insured the skid loader in that individual capacity, and that because Gaydos was not present at ACS at the time of injury, that Gaydos did not enjoy the protections of co-employee immunity. The Trial Court sided with Gaydos finding that he was a co-employee of Brown and, as a result, was automatically immune from civil liability under Section 72. A three (3) Judge panel of the Superior Court reversed finding a factual dispute existed as to whether Gaydos and Brown were acting “acting in the same employ” when Brown was injured. The Superior Court found facts presented by Brown could establish co-employee immunity does not apply because of the custody and control over the skid loader. It was also noted that because Gaydos was not on the ACS job site at the time Brown was injured raises additional course and scope questions preventing entry of summary judgment.</p>

  <p>Gaydos sought review by the Pennsylvania Supreme Court, which was granted.</p>

  <p>A majority of the Supreme Court Justices affirmed the Superior Court’s ruling citing it’s 1971 decision in <em>Apple v. Reichert</em>, holding that co-employee immunity applies to acts occurring when the alleged negligent actor is in the same employ as the injured worker and acting within the course and scope of their employment at the time of the worker’s injury. Brown had alleged that Gaydos was negligent in maintaining the skid loader outside of the co-workers’ employment relationship with ACS. Additionally, Gaydos was not on site when Brown was injured leaving a factual dispute as to course and scope of employment at the time of injury. If Brown’s position is accepted by the fact-finder, it is possible for a jury to conclude that co-employee immunity did not apply making entry of summary judgment improper.</p>

  <p>In short, a co-worker is not automatically immune from civil liability simply because the injured worker is employed by and works for the same employer. A closer analysis must be given to whether the alleged negligence occurred within the co-employee relationship and whether the negligence occurred while both workers were acting within the course of scope of employment at the time of injury.</p>

<p>The National Highway Safety Administration, in a filing dated Tuesday, October 7, 2025, reported 58 incidents of Tesla autonomous vehicles violating traffic safety laws while in full self-driving mode. Many of the Tesla drivers stated that car gave no warning about unexpected behaviors.</p>
<p>In August, 2025, a Miami jury found Tesla partly responsible for a deadly 2019 crash in Florida while in “auto pilot driver assist” mode (which is different than full self-driving). The jury verdict was in the amount of <strong>$240 million.</strong></p>
<p><h2>This new investigation covers <strong>2.8 million vehicles</strong>&nbsp;</h2>Essentially all Teslas equipped with Full Self-Driving technology (“FSD”). This investigation follows other probes into the FSD features on Teslas which has been blamed for several injuries and deaths. Tesla has repeatedly stated that the system cannot drive itself and human drivers must be ready to intervene at all times.</p>
<p>Tesla is also under investigation by the <a href="https://www.nhtsa.gov/">National Highway Transportation Safety Agency (NHTSA)</a> for its “summon technology” that allows drivers to tell their cars to drive to their locations to pick them up – a feature that has reportedly led to parking lot collisions.</p>
<h3>There are particular problems in low visibility conditions – including one case in which a pedestrian was killed.</h3>
<p>Tesla is under pressure to demonstrate it has corrected these defects. In the meantime, Tesla promises to put hundreds of thousands of self-driving Tesla cars and Tesla robo-taxis on roads by the end of 2026.</p>								</div>

										<content:encoded><![CDATA[<p>In its self-described first examination of the traveling employee doctrine, the Pennsylvania Supreme Court ruled 7-0 that employees who travel for work are entitled to a rebuttable presumption of being within the course and scope of employment during the entirety of work-related travel. This necessarily includes the worker’s travel home at the conclusion of the work activity and, in this instance, includes the worker’s voluntary attendance at an employer-sponsored after hours happy hour. In enforcing the protections afforded injured workers, Justice Mundy reminds of the liberal construction of the Pennsylvania Workers’ Compensation Act necessary to effectuate the law’s intended purpose of benefiting injured workers and their dependents. In other words, close calls and ties in interpreting the law are to go to the benefit of the injured worker.</p>
<p>In <em>Peters v. WCAB (Cintas Corp.),</em> No. 1 MAP 2020, 2021 Pa. LEXIS 4002 (Pa. Nov. 17, 2021), a portion of the injured worker’s duties required periods of travel. On the date of injury he had been traveling and providing business services to various clients. After completing his clear-cut work duties he drove to and attended a social gathering at a local restaurant sponsored by his employer. Accepting the lower Court’s fact finding, the High Court regards the worker’s attendance at the event as voluntary and not required by the employer. After leaving the restaurant and apparently on his way home, the worker was injured in a motor vehicle collision. The trial court, Appeal Board, and Commonwealth Court all held that the worker was outside of the scope of employment at the time of the crash and declined to award benefits. The Supreme Court was not so persuaded and specifically spoke to the broad protections afforded the injured worker by the Act, including the presumption that workers who travel to meet their employer’s objectives are historically afforded broader protection for injuries occurring while in transit. The High Court adopted the traveling employee doctrine finding the doctrine is implicated when the injured worker first proves that (1) he is a traveling employee and (2) that he set out on the day of the accident on the business of the Employer. In so finding the Court vacated the Order of the Commonwealth Court, and remanded the case for a determination on whether the injured worker had abandoned his employment at the time of the crash. Abandonment is an affirmative defense to the traveling employee doctrine which is available to Defendant employers/insurers. The Defendant carries the burden of proof on this point once the injured worker establishes his status as a traveling employee.</p>
<p>In addition to adopting the traveling employee doctrine <em>Peters</em> recognizes that non-mandatory, voluntary, social events hosted by an employer can be considered work-related for the traveling employee as these types of events foster relationships among co-workers and improve morale all inuring to the benefit of the Defendant-employer. The Court also declined to limit the protections of the traveling employee doctrine to fatal claims only, as argued by the defense.</p>
<p>The take home message for workers who travel for a living – the Pennsylvania Workers Compensation laws presume to protect and cover you from the time you start your work duties until the time you return home.
