Pennsylvania’s Statute of Limitations for Sexual Abuse Cases
The timeframe to file a claim depends on the nature of the abuse:
- Workplace sexual abuse: generally two years from the date of the incident.
- Child sexual abuse: survivors can file until age 30 for civil claims and until age 50 for criminal prosecution.

Attorney Neil O’Donnell secured settlements for four victims of former Pittston Area band director Brendan J. Carter, with all costs covered by insurance. Carter, sentenced in 2021 for abusing nine boys, worked in what experts called a “sexualized culture” within the district’s band program.
